Duncan R. MacKay

Duncan R. MacKay is Deputy General Counsel and Chief Compliance Officer at Eversource Energy (NYSE: ES), New England’s largest energy delivery company and a Fortune 500 utility.  With nearly three decades of in‑house experience, Duncan leads legal strategy for complex state and federal regulatory, SEC and corporate governance, labor and employment, and dispute resolution matters and has been a strong advocate for proactive dispute prevention and the effective, disciplined use of mediation, arbitration and other ADR processes.  He has driven the adoption of stepped dispute prevention and ADR clauses, early case evaluation, and ADR practices aimed at reducing cost, risk, and business disruption.  

A longtime leader in the ADR community, Duncan became an in-house counsel fellow of the Association of Commercial and Transactional ADR Professionals (ACT‑ADR), where he chairs the dispute prevention working group.  He also leads the ACC’s new ADR subcommittee, serves on CPR’s Executive Advisory Committee and co-chairs CPR’s dispute prevention committee, and serves as a member of the AAA‑ICDR Energy Advisory Committee.  Duncan is the recipient of the Association for Conflict Resolution-Greater New York Chapter’s (ACR‑GNY) 2025 Chuck Newman Award, and CPR’s 2025 James P. Groton Award for Outstanding Leadership in Dispute Prevention for his contributions to conflict resolution and dispute prevention.
